Terms and conditions of use of the mobile Application<\/strong><\/p>\n\n These terms and conditions of use of the mobile Application govern access to and<\/p>\n\n use of the ALBA ENERGY RENT mobile application (hereinafter referred to as the “Application”).<\/p>\n\n 1.<\/strong>Definition of terms<\/strong><\/p>\n\n The terms in these Terms, whether used in the singular or plural<\/p>\n\n plural, have the following meanings:<\/p>\n\n – “Application” means the ALBA ENERGY RENT mobile application available for<\/p>\n\n downloading from the Apple Store and Google Play Store to devices with operating systems<\/p>\n\n iOS or Android systems. This electronic service combines the capabilities of <\/p>\n\n receiving and transmitting information related to the relationship of the Application User<\/p>\n\n and the business entity ALBA ENERGY LLC, which is the tenant of the premises,<\/p>\n\n roofs and structural elements of buildings, etc. that belong to the Users by right<\/p>\n\n owned or managed by them – hereinafter referred to as the “Company”).<\/p>\n\n – “Terms” means these Terms and Conditions of Use applicable to the Application, and<\/p>\n\n as well as privacy policy and security issues.<\/p>\n\n – “User” means any person using the Application.<\/p>\n\n – The “Application Administration” (hereinafter referred to as the Application Administration or the Owner of personal<\/p>\n\n Data)” – authorized employees to manage the application acting on behalf of LLC<\/p>\n\n “ALBA ENERGY, which organize the processing of personal data, as well as<\/p>\n\n determine the purposes of personal data processing, the composition of personal data that<\/p>\n\n subject to processing, actions or operations performed with personal data.<\/p>\n\n – “Personal data” means any information relating directly or indirectly to a specific<\/p>\n\n to the subject of personal data – the User.<\/p>\n\n – “Personal data processing” means any action (operation) or set of actions (operations),<\/p>\n\n carried out with or without the use of automation tools<\/p>\n\n means with personal data, including collection, recording, systematization, accumulation,<\/p>\n\n storage, clarification (updating, modification), retrieval, use, transfer (distribution,<\/p>\n\n provision, access), depersonalization, blocking, deletion, destruction of personal data.<\/p>\n\n – “Confidentiality of personal data” – mandatory for the Administration to comply with<\/p>\n\n or other persons who have gained access to personal data, the requirement to prevent<\/p>\n\n their dissemination without the consent of the personal data subject or other legal basis<\/p>\n\n grounds.<\/p>\n\n 2.<\/strong>Authorization and work in the application<\/strong><\/p>\n\n 2.1. To use the features of the Application, the User must be authorized in<\/p>\n\n Application. By authorizing in the Application, the User agrees to these Terms and Conditions. 2.2. By authorizing, the User agrees to provide accurate and truthful information about <\/p>\n\n myself.<\/p>\n\n 2.3. For authorization, the User is provided with a login and password to enter his personal<\/p>\n\n office.<\/p>\n\n 2.4. The User is fully responsible for the security of his\/her login and password, as well as for<\/p>\n\n all actions to be performed under his\/her account in the Application.<\/p>\n\n 2.5. If the Application Administration suspects the User of committing<\/p>\n\n illegal actions, including the use of malicious programs, other acts that<\/p>\n\n violate these Terms, the Administration of the Application has the right to apply to the relevant state<\/p>\n\n authorities with an application and\/or block and\/or delete the User’s account.<\/p>\n\n 2.6. By agreeing to the terms of use of the mobile application, the User<\/p>\n\n confirms that he\/she has been informed about the processing of his\/her personal data (collection, accumulation,<\/p>\n\n processing, storage, use and distribution) in accordance with the requirements of the Law of Ukraine “On<\/p>\n\n Protection of Personal Data” and consents to their transfer to third parties.<\/p>\n\n 2.7. By agreeing to the terms of use of the mobile application, the User provides<\/p>\n\n The Operator has the right to send him messages containing information related to<\/p>\n\n presented in the mobile application or advertising information.<\/p>\n\n 3. User rights and obligations<\/strong><\/p>\n\n 3.1. The User undertakes to properly comply with the terms of these Rules and<\/p>\n\n conditions.<\/p>\n\n 3.2. The User is entitled to use the Application solely for the purpose of personal<\/p>\n\n use.<\/p>\n\n 3.3. The User undertakes not to use the Application in violation of the rights and<\/p>\n\n the legitimate interests of the Application Administration, other rights holders, third parties, and these Rules<\/p>\n\n and conditions.<\/p>\n\n 3.4. The User undertakes to take appropriate measures to ensure the safety of<\/p>\n\n his mobile device and is personally liable in case of access to his mobile device<\/p>\n\n third-party devices.<\/p>\n\n 3.5. The User is prohibited from independently or with the involvement of third parties to<\/p>\n\n decompile the Application, and reverse engineer the Application.<\/p>\n\n 3.6. The User is solely responsible for the use of the Application by any<\/p>\n\n in ways not expressly permitted by these Terms and Conditions.<\/p>\n\n 3.7. The User shall not perform any unauthorized actions with the Application.<\/p>\n\n 3.8. Before installing the Application in their mobile device, the User shall<\/p>\n\n get acquainted with all the information about it. Installing the Application on your mobile device <\/p>\n\n confirms that the User has fulfilled the obligation specified in this clause. In case of disagreement <\/p>\n\n with the terms of these Terms and Conditions, the use of the Application by the User shall be immediately<\/p>\n\n has been terminated.<\/p>\n\n 3.9. The user is given the opportunity to download and use free of charge<\/p>\n\n full functionality.<\/p>\n\n 3.10. The User agrees to the Application Administration to process his\/her<\/p>\n\n personal data, other data that the User provides by their actions, by posting them<\/p>\n\n in the Appendix. In this case, the purpose of processing personal data is, but not limited to: <\/p>\n\n \u27a2 ensuring the functionality of the Application services, \u27a2 facilitating the fulfillment of contractual obligations of ALBA ENERGY LLC and<\/p>\n\n User,<\/p>\n\n \u27a2 facilitating compliance with legal requirements,<\/p>\n\n \u27a2 transferring\/disclosing them to third parties, if necessary.<\/p>\n\n 4. Rights and obligations of the Application Administration<\/strong><\/p>\n\n 4.1. The Application Administration has the right to send the User in any way<\/p>\n\n information, including sending advertising, informational and other messages to<\/p>\n\n e-mail or phone number specified by the User, or post the relevant<\/p>\n\n information in the Appendix.<\/p>\n\n 4.2. The Application Administration has the right to block the User’s access to the services<\/p>\n\n Application or part of the services in case of detection of violations of these Terms and Conditions by the User.<\/p>\n\n 4.3. The Application Administration has the right to process personal data<\/p>\n\n the User, as well as other data provided by the User, to achieve the goals of<\/p>\n\n functioning of the Application.<\/p>\n\n 4.4. The Administration of the Application has the right to restrict without prior notice,<\/p>\n\n suspend or terminate the User’s use of the Application in case of acceptance<\/p>\n\n the relevant decision of the state or other authorized body, or in other cases<\/p>\n\n stipulated by the current legislation of Ukraine and International rules\/laws.<\/p>\n\n 4.5. The Administration of the Application may periodically make changes to these Terms and Conditions that<\/p>\n\n shall come into force from the moment they are published on the relevant page of the Appendix.<\/p>\n\n The user must read the Terms and Conditions before using<\/p>\n\n of the Application. This means that by using the Application, the User accepts and agrees to <\/p>\n\n the content set forth in the Terms and Conditions. If for any reason the User does not agree with <\/p>\n\n the content of these Terms, such User shall immediately stop using the Application.<\/p>\n\n 4.6. The Administration of the Application guarantees and declares that the safety and security of<\/p>\n\n personal data provided by the User and Confidential Information, is available to it<\/p>\n\n priority, which is ensured by physical, electronic and procedural means<\/p>\n\n protection, in accordance with the requirements established by the legislation of Ukraine. These means and requirements are <\/p>\n\n used to prevent unauthorized access or disclosure of information<\/p>\n\n about Users, to ensure the security and safety of information for Users, which<\/p>\n\n The Company exchanges them in this Appendix.<\/p>\n\n 5. Information processed and recorded by the Application<\/strong><\/p>\n\n The Application may collect the following information about the User:<\/p>\n\n 5.1. Personal data is:<\/p>\n\n \u27a2 Name, surname and patronymic<\/p>\n\n \u27a2 e-mail address<\/p>\n\n \u27a2 Phone<\/p>\n\n \u27a2 Name of the Company<\/p>\n\n \u27a2 Position<\/p>\n\n \u27a2 Service of interest to the user<\/p>\n\n \u27a2 IP address<\/p>\n\n 5.2. Confidential Information is: \u27a2 information about an individual, his\/her personal data, payment data, and other<\/p>\n\n information (including digital or statistical data) relating to a specific person<\/p>\n\n (the object belonging to it), etc., access to which will be obtained by the Application as a result of using<\/p>\n\n Service, or which will be sent by the User or received by the Application in any other way in<\/p>\n\n in the process of using the Application, including by accident (as a result of a technical failure,<\/p>\n\n errors, etc.).<\/p>\n\n \u27a2 information about the User’s identity received by the Application in the course of use<\/p>\n\n (information about the User’s devices, operating system, etc.);<\/p>\n\n \u27a2 information about the owner of the Application that is not public and could be obtained<\/p>\n\n By the User in the course of using the Application.<\/p>\n\n 5.3. Information authorized by the User through the Application settings<\/p>\n\n \u27a2 Geolocation data (GPS);<\/p>\n\n \u27a2 Display notifications;<\/p>\n\n \u27a2 Access via the device’s camera;<\/p>\n\n \u27a2 Auto refresh;<\/p>\n\n \u27a2 Using an Internet connection.<\/p>\n\n 5.4. Other information that can be used to ensure the operation of individual<\/p>\n\n application functions (including for payment through the application)<\/p>\n\n \u27a2 Launch third-party applications (email client, social networks, file viewers <\/p>\n\n etc.);<\/p>\n\n \u27a2 Use device storage to store application files;<\/p>\n\n \u27a2 Phone device metadata;<\/p>\n\n Other information about the User’s device, including the operating system, etc.<\/p>\n\n 6. Transfer of information to third parties<\/strong><\/p>\n\n 6.1. Information about the User is not disclosed to third parties, except when<\/p>\n\n the transfer of such information is necessary in connection with the fulfillment of the contract for the provision of services to the User, and<\/p>\n\n authorized state bodies in accordance with the current legislation of Ukraine.<\/p>\n\n 6.2. In turn, when using the Application and its services, the User<\/p>\n\n undertakes not to disclose in any way personal data, confidential<\/p>\n\n information that has become, or may become known to him while using the Application and its<\/p>\n\n services, any other individual or legal entity, to comply with the established<\/p>\n\n other restrictions on its use, to prevent unlawful<\/p>\n\n use of Confidential Information for your own benefit and\/or for the benefit of others<\/p>\n\n individuals and\/or legal entities, and\/or to the detriment of the personal data owner,<\/p>\n\n Confidential information and anyone to whom the information or data relates.<\/p>\n\n 6.3. The Parties realize that as a result of a failure of the Application, a virus or<\/p>\n\n hacker attacks, technical malfunctions and any other force majeure circumstances<\/p>\n\n the User’s personal data may become available to other persons. The User understands <\/p>\n\n and agrees that he\/she will not make any claims against the Application Administration in this regard.<\/p>\n\n 7. Information management<\/strong><\/p>\n\n 7.1. The User unconditionally agrees to such statements:<\/p>\n\n 7.1.1. The Administration of the Application will not sell, distribute or rent in<\/p>\n\n use of the User’s personal information to third parties, if the nature of the services<\/p>\n\n Applications, the use of which the User has agreed to, does not require this, or at the request of<\/p>\n\n controlling authority in cases provided for by the legislation of Ukraine.7.1.2. The Application Administration uses the User’s personal information <\/p>\n\n solely for the purpose of servicing the User on partnership terms, since the<\/p>\n\n the technical nature of the services requires the use of such data.<\/p>\n\n 7.2. As a User, within the framework of using the Application, the person realizes that through this<\/p>\n\n service The User is provided with access to the information necessary\/intended for the User in<\/p>\n\n electronic form, which relates to his\/her relationship with ALBA ENERGY LLC, including<\/p>\n\n information about:<\/p>\n\n \u27a2 indicators of metering devices generated by the equipment of ALBA ENERGY LLC<\/p>\n\n electric energy<\/p>\n\n \u27a2 current tariffs;<\/p>\n\n \u27a2 the amount of rent in the selected period;<\/p>\n\n \u27a2 etc.<\/p>\n\n 7.3. All information that is transmitted electronically by means of this<\/p>\n\n of the Company’s services, including information on meter readings, is considered to be<\/p>\n\n is valid and shall be taken into account when making settlements between ALBA LLC<\/p>\n\n ENERGY and the User.<\/p>\n\n 7.4. The User is personally responsible for changing, ensuring the safety and<\/p>\n\n disclosure of his\/her personal data to access the Application or services provided from it<\/p>\n\n assistance received through this Application or the relevant service, in case of any<\/p>\n\n risks of their disclosure or transfer to third parties directly by the User.<\/p>\n\n 7.5. The user of the Application agrees to the following statements:<\/p>\n\n \u27a2 all information received through the services of this Application is reliable, and in<\/p>\n\n in case of any discrepancies or inaccurate data contained in the received<\/p>\n\n The User of the information, the User should contact directly ALBA LLC<\/p>\n\n ENERGY”;<\/p>\n\n \u27a2 this Annex does not cancel or terminate legal relations arising in the course of<\/p>\n\n fulfillment of mutual contractual obligations between the User and ALBA ENERGY LLC;<\/p>\n\n The Application Administration is not responsible for the inability to provide<\/p>\n\n The user has all the information he or she needs.
